Tribunal upholds some Vancouver strata fines for 'offensive' name-calling

小蓝视频’s Civil Resolution Tribunal has ruled some of 小蓝视频 strata’s fines of an owner and a tenant for name-calling will stand.

In a , tribunal member Nav Shukla said Steven Erik Vestergaard was a tenant of Allister David Chan in a Vancouver West End building on English Bay.

The strata claimed Vestergaard had repeatedly breached strata bylaws for which it had levied fines.

As such, the strata sought a tribunal order that Chan and Vestergaard pay $2,200 for fines it has assessed for bylaw contraventions.

The strata further claimed it had spent approximately $9,220 in legal expenses as of Dec. 31, 2022 to enforce its bylaws.

The strata also sought an order that Chan and Vestergaard pay that amount as the cost of remedying Vestergaard’s bylaw contraventions under the Strata Property Act (SPA).

Chan and Vestergaard said they were not liable for the claimed fines and legal expenses.

The strata listed 11 allegations in which it detailed incidents including, among others, Vestergaard allegedly raising his voice on calls to strata council members, calling a council member a “crybaby,” and other residents a “weirdo” or “idiot,” and insulting someone’s height.

However, Shukla disallowed most of the fines.

“In total, I find Mr. Vestergaard owes the strata $800 in bylaw contravention fines. I find the remaining $1,400 in fines are not valid,” Shukla said. “I find Mr. Vestergaard and Mr. Chan are jointly and severally liable to the strata for the $800 in fines.”

Shukla dismissed the strata’s claim for legal fee reimbursement.

Chan claimed reimbursement for $9,607 for his legal fees. Shukla dismissed that claim as well.
