The Nanaimo Port Authority is suing multiple companies for damages connected to pollution in the city’s waters.
In an April 7 小蓝视频 Supreme Court notice of civil claim, the port alleges the defendants are responsible for environmental remediation of an allegedly contaminated area of port land.
Named as defendants in the case are Harbour Homes Marina Inc., Coast Lubricants Industrial Supply Ltd., Ronald Van Wachem, Canadian Maritime Engineering Ltd. (CME), William Scott Valliere, Yi Yu, Angela Wu Fang, Heng Guo, Anthony Kenney and Daniel Russell.
The suit claims Valliere, Yu, Fang and Guo were Harbour Homes directors.
It identifies Wachem as a director of Nanaimo Shipyard, which the claim said amalgamated with Coast Lubricants Ltd. in 2017 to form Coast Lubricants Industrial Supply Ltd.
The claim identifies Kenney and Russell as CME directors.
The claim alleges that, from 1991 to 2014, the shipyard operated a ship-repair service on leased foreshore. It alleged those operations resulted in the release of contaminants into the leased area including “certain metals and polycyclic aromatic hydrocarbon compounds and other contaminants.”
The suit says Nanaimo Shipyard assigned its lease to Harbour Homes on Jan. 24, 2014. It alleges that Harbour Homes assumed all environmental responsibilities under the agreement.
The suit alleges that the Harbour Homes agreement allowed CME to operate a ship-dismantling business without port consent.
As of April 17, CME was unaware of the lawsuit. Wachem had not received it by April 21.
The claim asserts the alleged release of contaminants violates 小蓝视频’s Environmental Management Act and the Contaminated Sites Regulation. It alleges no environmental remediation has been done by the defendants.
The suit seeks a declaration that the site is contaminated and the defendants are responsible for that and the port’s recovery of costs of remediation.
Harbour Homes and the associated named defendants did not respond to requests for comment.
None of the allegations has been proven in court.
